LAVASH RENTALS INC - TERMS OF SERVICE

Please read these Terms of Service ("Terms") carefully as they govern your use of Lavash Rentals Inc's washer and dryer rental services, including delivery, installation, maintenance, and removal (collectively, the "Service").

By booking our rental services, you agree to these Terms. If you do not agree to these Terms, then you must not use our Service.

1. Introduction

Service Provider

These Terms are between you and Lavash Rentals Inc, operating in Calgary, Edmonton, and Red Deer, Alberta.

Eligibility Requirements

To use our Service, you must:

  • Be 18 years of age or older
  • Have the power to enter a binding contract with us
  • Reside in our service area
  • Provide accurate and complete information during booking

2. The Service We Provide

Service Options

We provide washer and dryer rental services with two equipment tiers:

  • Basic Tier: Standard efficiency models
  • Premium Tier: High-efficiency, advanced feature models

Service Inclusions

Our rental service includes:

  • Professional delivery and installation
  • All repairs and maintenance (excluding misuse damage)
  • 24/7 emergency support for safety issues
  • Equipment removal upon lease termination

Service Limitations and Modifications

We use reasonable care to keep our Service operational. However, our service offerings may change from time to time without liability to you, including:

  • Temporary service interruptions due to technical difficulties, maintenance, or regulatory changes
  • Equipment model updates or substitutions with comparable units
  • Service area modifications

We have no obligation to provide specific equipment models, and equipment may be updated or replaced with comparable units without notice.

3. Your Use of the Service

Booking Requirements

You may book our Service through our website or approved booking platforms. Your booking must be for your primary residence within our service area.

Your Rights to Use the Service

Subject to your compliance with these Terms, we grant you limited, non-exclusive permission to use the rented equipment for personal, residential use only. This permission remains in effect until terminated by you or us.

Equipment Ownership

All equipment remains the property of Lavash Rentals Inc at all times. You receive only the right to use the equipment at your specified address. Equipment cannot be sold, transferred, moved, pledged as collateral, or used for commercial purposes.

4. Payments and Cancellation

Rental Fees

  • Monthly rental fee: $50 CAD per equipment set
  • Payment due: Same date each month as installation date
  • Payment method: Stripe payment processing (credit card, debit card)
  • Late fee: $10 CAD if payment is more than 5 days late

Billing and Cancellation

Rentals continue indefinitely until cancelled with 30 days written notice. You will be billed monthly and authorize us to charge your payment method the current rental fee.

You may cancel your rental at any time by providing 30 days written notice. Cancellation takes effect at the end of the notice period. We do not provide refunds for any partial rental periods.

7-Day Full Refund Guarantee

We offer a 7-day full refund guarantee from the date of installation. If you are not completely satisfied with your washing machine within 7 days of installation, you may request a full refund by contacting us in writing. Upon receiving your refund request within this period, we will:

  • Schedule equipment pickup at no additional cost
  • Process a complete refund of all payments made
  • Waive any cancellation fees or penalties

This guarantee applies regardless of the reason for dissatisfaction and supersedes all other cancellation terms during the 7-day period following installation.

Early Cancellation

Early cancellation fee: If rental is terminated within the first 3 months for any reason other than our default, you agree to pay a minimum of $150 CAD in total rental fees, regardless of actual rental period.

Replacement Costs

If equipment is stolen, damaged beyond repair, or becomes inaccessible due to your actions:

  • Basic Tier: $250 per washer, $200 per dryer
  • Premium Tier: $500 per washer, $400 per dryer

5. Your Responsibilities

Property Requirements

  • Provide adequate access for delivery, installation, maintenance, and removal
  • Ensure property has proper electrical, water, and drainage connections
  • Maintain 24-hour advance notice for service access (except emergencies)
  • Keep installation area accessible and unobstructed

Equipment Use and Care

  • Use equipment strictly according to manufacturer instructions and load limits
  • Pay all utilities required for operation (water, electricity, gas)
  • Keep equipment clean and in good condition through normal use
  • Report needed repairs immediately in writing
  • Never attempt repairs yourself or hire unauthorized repair services

Insurance Requirements

You must maintain appropriate tenant/renter insurance covering personal property and liability.

Property Access

You agree to provide reasonable access for:

  • Installation and removal (24-hour notice)
  • Routine maintenance and repairs (24-hour notice)
  • Monthly inspections (24-hour notice, maximum once per month)
  • Emergency situations (immediate access)
  • Equipment recovery in case of default (24-hour notice)

6. Our Responsibilities and Limitations

What We Provide

  • Professional delivery and installation
  • All equipment maintenance and repairs (except damage from misuse)
  • 24/7 emergency response for safety issues
  • Equipment removal upon lease termination
  • Compliance with Alberta safety standards

Liability Limitations

We are not responsible for:

  • Property damage from equipment malfunction (unless due to our negligence)
  • Inconvenience during repair periods
  • Normal equipment operation when used within manufacturer specifications
  • Damage caused by misuse, overloading, or improper operation

Your Liability: You accept full responsibility for damage, theft, or loss due to misuse, overloading, negligence, or failure to follow manufacturer guidelines.

7. Default and Termination

Events of Default

  • Non-payment for 10+ days
  • Breach of any terms in this agreement
  • Equipment removal or attempted removal from premises
  • Failure to provide access for repairs or maintenance
  • Overloading or misusing equipment contrary to manufacturer guidelines

Consequences of Default

  • Immediate equipment removal rights
  • All unpaid rent becomes immediately due
  • You remain liable for remaining minimum term (if within first 3 months)
  • Recovery of legal fees and collection costs

Termination Effects

Upon termination, your right to use the equipment immediately ends. Sections covering liability, payment obligations, and dispute resolution survive termination.

8. Legal Compliance and Dispute Resolution

Governing Law

This agreement is governed by Alberta law and must comply with:

  • Alberta Residential Tenancies Act
  • Alberta Consumer Protection Act
  • City of Edmonton/Calgary/Red Deer bylaws
  • Alberta Health and Safety Standards

Dispute Resolution

Any disputes will be resolved in Alberta courts. You may also have rights under Alberta consumer protection legislation.

Limitation of Liability

Our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim, or $300 CAD, whichever is greater.

9. Communication and Privacy

Written Communication

All notices must be in writing and delivered by email, text message, registered mail, or in person with receipt confirmation.

Privacy

Your personal information is handled according to applicable privacy laws. We collect only information necessary for service delivery and billing.

10. General Terms

Agreement Modifications

Changes to these Terms will be communicated in advance and take effect on the date specified. Continued use of our Service after changes take effect constitutes acceptance.

Entire Agreement

These Terms constitute the complete agreement between you and Lavash Rentals Inc regarding our Service.

Severability

If any provision is found invalid, the remainder of the agreement remains enforceable.
